Navigating Distressed Loans and Disputes
In our work with distressed loans and disputes, we’ve observed many instances where changes in a lender’s personal and business life have led to challenges. Family law issues and changes in personal relationships can impact not only a lender’s ability to directly repay but also often result in a loss of focus on the business. Additionally, diversification, a new purchase, or a sideline issue can similarly divert focus and funds to other purposes.
Our Experience
In some instances, we’ve been appointed as a receiver or administrator to take possession and secure assets to repay a lender. In others, lenders have appointed us to liaise with a competitor’s voluntary administrator to achieve the best outcome without appointing a receiver. On occasion, lenders have retained us to oversee the outcomes achieved by an administrator and concurrently arrange a settlement, thus avoiding formal appointment.
Over time, we’ve been recognised for our expertise in this area, both as active participants in proceedings and as a driver of solutions. This is evident in a recent role where we were appointed as a receiver to a parts and distribution business on behalf of the lender after the business appointed a voluntary administrator. Within 12 hours, we determined that the costs of receivership would exceed the benefits in this case, and we resigned from the receivership. We continued to work with the administrator to mitigate the lender’s exposure.
In another appointment to a fashion retailer, our network and reputation enabled us to arrange for our clients’ first-ranking security to be purchased by the voluntary administrator over the course of a weekend.
